ElixaMD is contemplated for specific non-emergency medical conditions and concerns. If you believe you are experiencing a medical emergency, please dial 911 or your local medical provider.
This User Agreement (collectively with ElixaMD’s Privacy Policy) applies to your use of all sites (collectively, the "Sites") to which this User Agreement is linked, and the services, features, content or applications (together with the Sites, the "Services") offered by ElixaMD and our affiliated brands and products. The terms “we”, “us”, “our” and “ElixaMD” refer to ElixaMD, LLC, a Delaware corporation located at 16192 Coastal, Highway, Lewes, Delaware 19958.
Please read this User Agreement carefully as it sets forth the legally binding terms and conditions for your use of our Services.
THIS USER AGREEMENT CONTAINS A MANDATORY ARBITRATION PROVISION IN SECTION XXI WHICH INCLUDES A CLASS ACTION, CLASS ARBITRATION, AND JURY TRIAL WAIVER. THESE PROVISIONS REQUIRE THE USE OF ARBITRATION TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS. BY ACCEPTING THESE TERMS, YOU EXPRESSLY AGREE TO BE BOUND BY AND ABIDE BY THIS AGREEMENT, INCLUDING THE MANDATORY ARBITRATION PROVISION AND THE CLASS ACTION WAIVER PROVISION.

I. Introduction
These Terms of Use (the “Terms”) describe your rights and responsibilities regarding the ElixaMD website (“website” or the “Platform”) owned and operated by ElixaMD.II. Eligibility
You must be at least eighteen (18) years of age and legally able to enter into binding contracts to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements.III. Privacy and Health Information
Your submission of personal information through the Services is governed by our Privacy Policy. In addition, to the extent you provide protected health information (“PHI”), ElixaMD will maintain such PHI in compliance with applicable privacy and security laws, including the Health Insurance Portability and Accountability Act (“HIPAA”). ElixaMD may act as a Business Associate for healthcare providers and will safeguard PHI accordingly.IV. Use of Services
You agree to use the Services only for lawful purposes. You must not:- Use any robot, scraper, or automated means to access the Services.
- Interfere with or disrupt the integrity or performance of the Services.
- Attempt to gain unauthorized access to the Services or related systems.
- Impersonate any person or misrepresent your identity. - Use the Services for fraudulent, harmful, or illegal activity.
Violation may result in suspension or termination of your account and potential legal action.
V. Independent Providers
Healthcare providers delivering services through ElixaMD are independent professionals solely responsible for the medical care and treatment they provide. They are not employees, agents, or representatives of ElixaMD. ElixaMD does not practice medicine and does not control or interfere with the professional judgment of providers. We are not responsible for any diagnosis, treatment decision, or outcome of medical care.VI. Payments and Refunds
You agree to pay all fees associated with your use of the Services. Unless otherwise stated, fees are non-refundable. Subscription services will automatically renew at the end of each billing cycle unless canceled in accordance with our cancellation policy.ElixaMD’s Weight Loss Program offers a specific refund guarantee: after completing five (5) consecutive months of active program participation, if you have not achieved a minimum of 5% body weight reduction, you may request a refund of all monthly membership fees paid, minus the initial provider consultation fee. Proof of adherence may be required.
VII. Electronic Communications and Notices
By using the Services, you consent to receive communications from ElixaMD electronically. Notices will be deemed delivered when sent to the email address or phone number you provide or when posted within the Platform. You are responsible for keeping your contact information current.VIII. Termination and Survival
We may suspend or terminate your access to the Services at any time, without notice, for any reason. Upon termination, all rights granted to you will immediately cease. Sections relating to payment obligations, intellectual property, disclaimers, limitation of liability, dispute resolution, and any provisions intended to survive termination shall survive.IX. Modifications to Services
We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice or liability to you.X. Intellectual Property
All content, trademarks, service marks, trade names, logos, and other intellectual property rights appearing within the Services are owned by or licensed to ElixaMD. You must not copy, distribute, modify, create derivative works of, publicly display, or reverse engineer any portion of the Services. Removal of copyright or proprietary notices is prohibited.XI. Third-Party Providers and Services
ElixaMD may facilitate your access to third-party providers, such as laboratories and pharmacies. These providers are independent contractors and not under ElixaMD’s control. We are not responsible for their acts, omissions, or errors. You must address any disputes regarding third-party services directly with the relevant provider.XII. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied. ElixaMD does not warrant uninterrupted access or error-free operation. We disclaim all liability for the acts or omissions of independent providers, third-party vendors, and other users of the Services.XIII. Limitation of Liability
To the maximum extent permitted by law, ElixaMD shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or loss of profits, data, goodwill, or reputation. Our total liability for any claim arising from or related to the Services shall not exceed the greater of five hundred dollars ($500) or the total amount of fees you paid to ElixaMD in the twelve (12) months preceding the claim. Any claim must be brought within one (1) year of the event giving rise to it.XIV. Indemnification
You agree to indemnify, defend, and hold harmless ElixaMD, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of or related to your use of the Services, violation of these Terms, or infringement of third-party rights.XV. Assignment
You may not assign or transfer these Terms without our prior written consent. ElixaMD may freely assign or transfer its rights and obligations under these Terms.XVI. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. For claims not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware.XVII. Dispute Resolution and Arbitration
Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its applicable rules. Arbitration shall take place in Delaware. You and ElixaMD waive the right to a jury trial or to participate in a class action. This arbitration provision shall survive termination of your use of the Services.XVIII. Copyright Infringement
If you believe that any content on the Services infringes your intellectual property rights, please notify our designated copyright agent in accordance with the Digital Millennium Copyright Act (“DMCA”). Notices must include all required elements under 17 U.S.C. § 512.XIX. Time Limit to Bring Claims
You agree that any claim you may have arising out of or related to the Services must be filed within one (1) year after such claim arose; otherwise, your claim is permanently barred.XX. Entire Agreement
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and ElixaMD concerning your use of the Services. XXIII. Independent Medical Judgement
ElixaMD is not licensed to practice medicine and does not provide any healthcare service. ElixaMD does not control or interfere with the provision of Healthcare Services provided by any Provider, which include medically trained clinicians and their affiliated Medical Groups, each of whom is independent from ElixaMD and solely responsible for the healthcare service you receive. You understand and agree that ElixaMD is not responsible for any Healthcare Service provided by a Provider or their Medical Group, including any personal injury or property damage. You further understand and agree that after reviewing your information, the Provider in their independent professional judgment, will determine whether to prescribe medication, other treatments, or, alternatively, recommend that you consult with alternative clinical resources.XXIV. Links to Other Websites or Resources
The Site may contain, and the Site or third parties may provide, advertisements and promotions offered by third parties and links to other websites or resources. You acknowledge and agree that ElixaMD is not responsible for the availability of such external websites or resources, and does not endorse and is not responsible or liable for any content, information, statements, advertising, goods or services, or other materials on or available from such websites or resources. Your correspondence or business dealings with, or participation in promotions of, third parties found in or through the Site, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. *The assessment made available on the ElixaMD website does not create a doctor-patient relationship between the individual completing the assessment and ElixaMD. OpenLoop Health, a network of US-licensed doctors that adhere to rigorous medical protocols designed for patient safety, has established exclusionary criteria to determine if an individual does not qualify for GLP-1s. The answers an individual provides to the ElixaMD assessment consequently determine if the individual is screened out of eligibility for GLP-1 medication, and an OpenLoop Health clinician will meet with an individual after checkout to determine if they qualify for a prescription. OpenLoop Health clinicians retain the decision to prescribe compounded GLP-1s to patients.
All claims and benefits on this website refer to self-reported data from GLP-1 customers on a treatment plan that includes compounded GLP-1 medications and consultations with medical professionals. Customers reported their weight on their initial medical intake questionnaire every 3-4 weeks thereafter. We are partnered with multiple USA certified pharmacies to bring the best product and overall experience to our membership. Our team meets regularly with pharmacies to discuss any product shortages, shipping delays, and get updated reports on their medication testing.
